This website is operated by, and these Terms and Conditions (T's and C's) are binding on, Diam Capital 35 West 45th Street, NY, NY 10036 Tel+ 1 (646) 758 0287, trading as www.diamondvaluation.com and on every customer of DiamondValuation.com. We use White Pine Trading Limited a US company, formed 01/08/2010 in Delaware, with EIN and Sales Tax ID: 27-1651774 to handle the fulfillment of all inquiries from www.diamondvaluation.com .
By posting goods to White Pine Trading, each customer agrees to all the T's and C's.
Every customer must be at least 18 years of age in order to sell items to Diamondvalution.com. Every customer must be the actual legal owner of all gold, jewellery and other property sold or attempted to be sold to Diamondvalution.com. Every customer must be acting on his or her own behalf and not as the agent or representative of another person.
At Diamondvalution.com request, the customer will provide documentation or other proof that complies with the requirements contained in these T's and C's.
The customer guarantees all of the following:
Posting and Insurance
- that no items sent to us are the result of illegal activity in the USA or any other country;
- that any transaction initiated by the customer will not cause Diamondvalution.com to be in violation of any anti-money laundering, anti-terrorism, or other applicable law of any country;
- not to send any hazardous material to Diamondvalution.com and
- not to send Diamondvalution.com material that does not contain diamond.
All items sent to White Pine Trading must be via FedEx Overnight, using the shipping label sent to you. All items posted to us are insured by G4Si for the amount stated in the email you receive to confirm your insurance. In order to arrange adequate insurance White Pine Trading may request further information from you regarding the items you intend to send to us, and will rely on this information in order to arrange insurance.
White Pine Trading will open every pack which it receives from customers under video, and will weigh and, where relevant, test the diamond items included in the pack, and compare them to the details received from the customer both prior to sending, and on any form signed and sent to us. Diamondvaluation.com reserves the right to reject any forms (and the items they are sent with) which are not properly completed and signed. White Pine Trading also reserves the right to reject delivery of any package which appears to be opened, damaged, or tampered with in any way. Any such packages we reject will be returned to you - at our cost - but without any liability to Diamondvaluation.com.
Valuation and Offer
Once your items have been received they will be tested and evaluated by our specially trained experts to determine their value. White Pine Trading may need to remove a diamond to adequately value it. We will ALWAYS contact you and get your consent to the removal of a diamond before doing anything. By sending us your jewellery you accept that the process of determining a value of the metal may involve placing certain acids on the gold, silver, platinum or other items which can leave permanent staining and/or scratches. WPDiamonds.com is not liable for any damage caused in this way or any resulting decrease in the value of the items. If we buy your items, this becomes irrelevant anyway.
When we make you an offer, it will be valid until 5pm EST. the following day. As the prices of diamond and gold and other precious metals change regularly, our offers cannot generally be extended beyond then. Once you have accepted our offer, the goods can be immediately shipped for diamond removal and melting down so your acceptance is legally binding on both of us and it is irrevocable. Please note that when accepting an offer, any no value items will not be automatically returned unless specifically requested at the time of the offer.
How do I get paid?
After our offer has been accepted, we will arrange payment details with you. We will pay by one of the following payment methods, no later than the working day after you accept our offer:
Direct bank transfer to your Account.
We can pay straight into the account of your choice in the USA, with funds leaving our account the day after you agree to our offer. There is no charge for this service. We will send you a payment receipt confirming the money has been transferred.
We can send you a check within 5 working days after you have agreed to our offer - at no charge to you. We will send you a payment receipt along with the check to the same address to which you provided to us in the initial inquiry through the Diamondvaluation.com website.
Nearly all our customers accept the offer we make them, but if you decide not to accept our offer for your items, your goods will be returned to you - at our cost, within five (5) working days from when you declined our offer.
However, if you only send items containing no diamond content, there is a $25 fee for returning them, or we can dispose of them free of charge. Your payment must be received within 28 days or the items will be disposed of.
If returned items are not able to be delivered by the FedEx because they have been unable to obtain a signature, they will leave an instruction card. If the package is returned to local delivery office, it will need to be collected within a period of time specified by the FedEx. If, however the package is not collected within this time, it may be returned to us. On receipt of the returned items, we will contact you to arrange for the items to be resent; however there will be a charge of $20 to cover the additional postage and administration costs. Payment must be received within 21 days of contacting you or we reserve the right to purchase the items at our offer price excluding our administration costs and holding insurance fee. When returning your original items White Pine Trading shall, in its own discretion, choose the return carrier and relevant insurance for each such return. Neither Diamondvaluation.com or White Pine Trading is not liable for any items becoming damaged. We may be independently insured against any such loss, and in the event of any claim, the customer agrees to provide all such information as we or our Insurance company may reasonably request including signing for the returned package.
If items are sent to us without a completed customer form it is unlikely we will be able to identify the sender unless the name and address has been written on the FedEx box. If the Shipping Label was requested via our website we may be able to identify the sender using the references numbers of the label. If, however we are not able to identify the sender then the items will be classed as lost property. We will continue to hold these items for a period of 6 months in a secure area. Customers claiming items will be required to provide a full and detailed description before an offer is made. Once we have confirmed a successful lost property claim, we will make payment for the items at our current price. If the items have been held in excess of 3-months, a deduction will be made from this payment to cover our storage and administration costs.
If a claim is not made within 6 months the items will be refined to recover our storage and insurance costs of $7.50 per week. If a claim is made after the items have been refined, a payment will be made for any outstanding amount due.
Items sent in Error (not intended for us)
Our Shipping Labels envelopes are coded with a unique license and are for customers sending precious metal with the intent to sell. If you use our Shipping Labels to send items intended for someone else - they will be sent to us. The fee for returning these items is $30, this covers the postage, insurance and administration costs.
This Agreement shall be governed by the laws of the United States of America
Diamondvaluation.com failure to exercise or enforce any right or provision of these T's and C's will not be deemed to be a waiver of such right or provision. If any provision is found by a court of competent jurisdiction to be invalid, the parties nevertheless agree that the court shall endeavour to give effect to the parties' intentions as reflected in the provision and the other provisions of these T's and C's will remain in full force and effect. Customers agree that regardless of any statute or law to the contrary, any claim or cause of action arising out of or related to use of the services offered by Diamondvaluation.com must be filed within one (1) year after such claim or cause of action arose. Any such claim or cause of action must be filed in the USA.
You agree to indemnify and hold harmless Diamondvaluation.com against any and all liability, claims, suits, losses, costs and legal fees caused by, arising out of, or resulting from any breach or claimed breach by you of these T's and C's, including claims brought by third parties.
Diamondvaluation.com reserves the right to change these T's and C's and advise you to revisit our website, at www.Diamondvaluation.com.com, periodically to ensure that you are aware of our current T's and C's. If a customer sends items more than once, it is your responsibility to check the T's and C's on each separate occasion that you choose to send us diamond items to ensure you know our latest T's and C's by which you agree to be bound by sending those subsequent items to us.
Diamondvaluation.com complies with all requirements of the data protection laws. Your information will only be used if you have given us permission to do so. Any bank account or similar details you provide will be treated confidentially and will only be stored subject to high security methods and only if we have your permission in advance.
